Essentially there are two exposures for the employer arising from an employee injury. First is the compensation exposure created by an injury arising as part of the work environment and therefore subject to workers compensation laws. Second is the employer's liability exposure that exists beyond the liability defined by workers compensation legislation. In most states, the employer is obligated to provide workers compensation benefits. A compensable workers compensation injury must (1) cause impairment, (2) result from an accident or an occupational disease, and (3) be work related. Benefits covered by workers compensation may include medical expenses, disability income or death benefits to replace lost wages, and rehabilitation services to help the injured employee return to work.
